These terms and conditions (‘Terms’) cover Green Star Media websites (‘Website’’Websites’): soccercoachweekly.net, elitesoccercoaching.net, rugbycoachweekly.net, basketballcoachweekly.net, womenssoccercoaching.com, womensrugbycoaching.com sportsperformancebulletin.com and sportsinjurybulletin.com. The Websites are owned and operated by Green Star Media, MBX124, 19 Moorfield Road, Slyfield Industrial Estate, Guildford, GU1 1
By visiting a Website or using a Green Star Media subscription product (‘Subscription product’) or book, DVD (‘Single product’) or other product published by Green Star Media (collectively called ‘Product’ ‘Products’) you are entering into an agreement with Green Star Media and agree to the following terms and conditions (the ‘Terms’). They represent a contract between you and Green Star Media. When you use any of our Services you agree to be bound by these Terms.
1. Intellectual Property
1.1 The contents and design of the Website, Subscription product and Single product and any other materials sent to you (the ‘Content’) are the property of Green Star Media. You may not use or reproduce, or allow anyone else to use or reproduce any trade marks, such as a Website logo, for any reason without written permission from Green Star Media.
1.2 The software that operates the Website may not be used except as expressly allowed under these Terms. You may not copy, reverse engineer, modify, cause damage or otherwise make changes to the software.
2. Use of Green Star Media Content
2.1 The Content is strictly for personal, non-commercial use. You may display the Content on a computer screen or mobile device, print individual pages and store them in electronic form on your computer or mobile device for your personal, non-commercial use.
2.2 You may not copy, reproduce, record, modify, transmit to any other website, remove trademark or copyright notices from, or commercially exploit the Content, except as stated above, and without written permission from Green Star Media.
2.3 To request permission for Content use not specifically permitted in the Terms please contact firstname.lastname@example.org.
3. Passwords and your Personal Information
3.1 Access to certain areas of the Website may only be open to registered users or subscribers. Each registration and subscription is for the personal use of the registered user or subscriber only. You may not share your username and/or password with any other person. You may not share or transfer your subscription.
3.2 In the case of Club and multi-user licence subscriptions, each person named on the subscription order will be responsible for the use and security of their own personal username and password.
3.3 You are responsible for the use of the Content using your username and password. You agree to immediately notify Green Star Media if you become aware of the loss, theft or unauthorised use of your username and/or password, or unauthorised use of the Content.
3.4 You are responsible for keeping your personal information, including your email address up to date and your username and password secure.
3.5 If a registered user or subscriber is found in breach of the Terms, Green Star Media may cancel or suspend access to the Website without further obligation to you.
4. Subscription and Single Product Orders
4.1 By submitting an order on a Green Star Media Website, you (‘Customer’’Customers’) agree to these terms for supply of Green Star Media Products offered by Green Star Media.
Your contract with us is made only on the first to happen of:
4.1.1 we send a Product to you
4.1.2 we authorise you to download a Product
4.1.3 we provide paid-for access to Content online
4.1.4 you have sent a completed instruction to us and paid for the Product you have ordered, and we have provided access to the Product/sent you the Product or a link to download the Product
5. Terms of delivery
5.1 Subscription products are delivered online, via the product website for the specified subscription period. Subscribers are emailed when new content is added to the website. Soccer Coach Weekly, Elite Soccer, Rugby Coach Weekly and Basketball Coach Weekly, Peak Performance and Sports Injury Bulletin subscription products are website based and paid subscribers receive unlimited content access. Any free gifts provided with a subscription are download only and sent directly to the subscribers account area.
Elite Soccer subscription is delivered via email monthly (12 issues a year) in PDF format, plus access to a website archive. Any Elite Soccer free gifts are to the customers account are on the website.
5.2 Single products are available in digital (Ebook), DVD and hard copy (Hard copy products) formats. Ebooks are delivered via email. The email includes a link for the customer to view and download their Ebook. Hard copy products are delivered by national and international postal services. Customers who purchase an Ebook while logged to a Green Star Media website have the download sent direct to their account area.
5.3 Green Star Media is not responsible for non-delivery of Subscription products and/or Ebooks due to circumstances beyond its control, such as filtering of Green Star Media email by email blocking services, the movement of email to junk or spam folders, an error in the email address provided to us, or you did not provide us with an updated address.
6. Order processing
6.1 Green Star Media will process your order as promptly as possible but does not guarantee a specified time. Your order will be accepted by us once we have verified your payment and delivery details. The fulfillment of a Subscription product does not signify acceptance.
6.2 When you place an order, you must provide us with complete and accurate payment information. By submitting your payment details you confirm you are entitled to use those payment details for this purpose. If we do not receive payment authorisation from the issuing bank/payment provider or authorisation is subsequently cancelled we may immediately rescind or suspend your subscription and/or website access.
7.1 Automatic Renewal
7.1.1 Unless specifically stated at the time of order, you agree your Subscription products will be automatically renewed at the end of the initial subscription period, and subsequent periods thereafter (as selected by you on the Subscription product order: 1 month, 3 months, 6 months or 12 months), using the initial payment method. Unless you cancel your subscription in advance of the renewal date, your credit card, bank account or PayPal account will be automatically charged, at the then prevailing rate, which may be changed from time to time.
7.1.2 You will not be notified in advance of a payment being taken. Unless requested in writing you not be sent a receipt for successful renewal payments taken.
7.1.3 If your renewal payment is declined by the issuing bank, credit card provider or PayPal, you will have 30 days to provide a new payment mandate or your subscription will be cancelled. If the subsequent charge is successful and we receive payment within the 30 days, your subscription period will be based on the original renewal date and not the date the subsequent payment is taken.
7.2 Trial Subscriptions
7.2.1 Unless specifically stated at the time of order, you agree your trial to a Subscription product will be automatically renewed at the end of the initial trial subscription period (30 days, or as otherwise stated on the trial subscription order form), for the period and subsequent periods (as selected by you on the trial Subscription product order: 1 month, 3 months, 6 months or 12 months) thereafter, using the initial payment method. Unless you cancel your trial subscription in advance of the trial expiration date your credit card, bank account or PayPal account will be automatically charged, at the then prevailing rate, which may be changed from time to time.
7.2.2 You will not be notified in advance of a payment being taken. Unless requested in writing you will not be sent a receipt for successful renewal payments taken.
7.2.3 If your renewal payment is declined by the issuing bank, credit card provider or PayPal, you will have 30 days to provide a new payment mandate or your subscription will be cancelled. If the subsequent charge is successful and we receive payment within the 30 days, your subscription period will be based on the original renewal date and not the date the subsequent payment is taken.
7.3 Fixed Term Subscriptions
7.3.1 If you do not choose an automatic renewal payment option we will contact you towards the end of the initial subscription period with an offer to renew your subscription.
8. Cancellation and Refunds
8.1 This and the following paragraph apply if you buy as a consumer as defined in the Consumer Contracts Regulations 2013. Provided the Regulations apply to the transaction concerned, then the following terms apply to this contract.
8.1.1 Every Product provided by us is designated to be delivered immediately or as soon as we are reasonably able to deliver it. Most Products are supplied automatically after you have made payment.
8.1.2 We do not supply any Product on terms for future delivery. That means, if you wish to use our Products, you must instruct us to deliver in accordance with our terms.
8.1.3 By accepting these terms, you now agree that you are instructing us to deliver immediately and you understand that, in doing so, you lose your right to cancel your order within 14 days and receive a full refund.
8.1.4 For new subscription orders, excluding trial subscriptions, if you cancel your subscription within the first 30 days of your contract with us starting, and before your renewal payment is taken (whichever comes sooner), you will receive a pro-rata refund for issues left unserved based on your initial payment.
8.1.5 As per Clause 12, if you wish to cancel a subscription paid for through your PayPal account you must cancel your payment authorisation to PayPal via your PayPal profile to avoid future payments to Green Star Media. Green Star Media cannot cancel your payment authorisation to PayPal to make payments to Green Star Media, on your behalf.
8.1.6 There are no refunds for trial subscriptions or products purchased as a PDF download, this includes the PDF & printed option offered.
8.1.7 If you are entitled to a refund under these Terms, it will be made to the credit card or PayPal account used for the original purchase, unless it has expired and in which case we will contact you. If you originally paid by Direct Debit you will need to contact your bank for a refund.
8.2 To cancel your subscription or trial subscription email email@example.com, or visit your account area on the website – To cancel on the website just log in – go to ‘my account’, then click ‘subscription’. If you fail to cancel your agreement before your renewal date and you are charged (renewed) according to your instructions, Green Star Media will not be held liable for any charges incurred, and no refunds or partial refunds will be given.
8.3 If your subscription is terminated by Green Star Media should you be in breach of these Terms you will not be entitled to a refund.
8.4 If your subscription includes a free gift, you agree that once the free gift has been shipped any eligible refund made during the cooling off period will be made net of the cost of fulfilling the free gift.
9. Contract and Disputes
9.1 Green Star Media will provide Subscription products in accordance with these Terms and the terms of any offer or promotion that may apply to your Subscription order. Should you have any queries contact firstname.lastname@example.org
10. Fees and Payments
10.1 The Subscription product price will be made clear to you on the order form or otherwise during the order process, and may vary from time to time. You agree to pay the fees at the rates notified to you at the time you purchase your Subscription product together with any associated fees charged by the issuing bank/payment provider, such as currency exchange rate processing fees.
10.2 We will always let you know in advance of any increase in the subscription price and offer you the opportunity to cancel your subscription if you do not wish to pay the new price.
11. Direct Debit Guarantee: For Direct Debit Orders
11.1 This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits. If there are any changes to the amount, date or frequency of your Direct Debit, Green Star Media Ltd will notify You 14 days in advance of your account being debited or as otherwise agreed. If you request Green Star Media Ltd to collect a payment, confirmation of the amount and date will be given to you at the time of the request. If an error is made in the payment of your Direct Debit by Green Star Media Ltd or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. If you receive a refund you are not entitled to, you must pay it back when Green Star Media Ltd asks you to. You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us by email.
12. PayPal: For PayPal Orders
12.1 You authorise PayPal to make payments to Green Star Media in line with the subscription offer and these Terms. To cancel this authorisation, you must access your PayPal account or contact PayPal directly. Please see PayPal’s terms and conditions. If you fail to cancel your agreement with PayPal, and you are charged according to your instructions, Green Star Media will not be held liable for any charges incurred, and no refunds or partial refunds will be given.
12.1.1 In the event Green Star Media fails to receive payment from your PayPal account for whatever reason, and your subscription is cancelled by Green Star Media. You understand you are still obliged to cancel your payment authorisation with PayPal to avoid PayPal sending payment to Green Star Media in the future.
12.1.2 In the event you choose to cancel your subscription you understand you are obliged to cancel your payment authorisation with PayPal to avoid PayPal sending payment to Green Star Media in the future.
14. Changes to the Website and Subscription products
14.1 Green Star Media reserve the right to suspend, change or modify the Content, or to restrict use and access to the Content, at its discretion, at any time.
15. Changes to Terms
15.1 We may at our discretion change these Terms.
15.2 Whenever Terms are changed we will publish revised terms on this website.
15.3 Your continued use of this website and our Products constitutes your acceptance of the changes.
16. Limitation of Liability
16.1 Every effort has been made to ensure the accuracy and safety of the information and advice provided in the Content. Green Star Media makes no warranty or guarantee to the completeness, accuracy or timeliness of the Content and is not responsible for any errors or omissions. In no event will Green Star Media, its affiliates or suppliers be liable for direct, special, incidental or consequential damages (including without limitation, damages for personal injury or related claims) arising directly or indirectly from the use (or failure to use) the Content.
16.2 You agree to indemnify us against any claim or demand made by any third-party due to or arising in any way out of your use of the Content, or the infringement by you, or by any other person accessing the Content using your user name and password, of any intellectual property or other right of any person.
16.3 Green Star Media will be responsible for any losses you suffer as a result of us breaching these Terms, if the losses were reasonably foreseeable to you and us when you purchased a Product. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) nor will we be responsible for any other indirect or consequential loss that is not reasonably foreseeable to you and us when you made your purchase.
16.4 Green Star Media does not limit in any way our liability by law for death or personal injury caused by our negligence or breach of duty or caused by our gross negligence or wilful misconduct. Subject to the proceeding sentence, our maximum liability to you will not exceed the last Subscription product fee you paid.
17. Events Beyond our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these Terms, if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
18. Governing Law
These Terms are governed by and shall be construed in accordance with English Law. Any disputes or claim arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
